Welcome to Upside. These Rules & Regulations (the “Rules”) explain how the Game is played fairly, what is and is not allowed, and how we handle violations. These Rules supplement our Terms of Service, End User License Agreement, and Privacy Policy, and they apply to every player of Upside (the “Service”).
By playing Upside, you agree to follow these Rules. If you do not agree, please do not use the Service.
1. Purpose of These Rules
We want Upside to be fun, fair, and safe for everyone. These Rules exist to:
- Protect the integrity of gameplay and the leaderboard.
- Keep the in-app economy (Points and rewarded ads) honest.
- Ensure that advertising and in-app purchases operate as intended.
- Provide clear expectations so players know what behavior is and is not acceptable.
2. Gameplay Rules
2.1 How the Game Works
Upside is a precision stacking game. You tap to drop blocks and try to stack them as accurately as possible. As you play:
- You earn Score by placing blocks. Perfect matches give bonus score.
- You earn Points (◆) at a rate of 1 Point for every 100 score. Points persist across sessions.
- You can use Points to purchase a “golden block” during a run, starting at 10 Points and scaling upward each purchase within the same run.
- When you fail, you are offered a Continue screen with two options: (a) watch a rewarded video ad to continue, or (b) spend Points on a golden block.
- Your top scores are saved to a local leaderboard on your device.
2.2 Fair Play
You must play the Game honestly. Specifically, you must not:
- Use any cheat, hack, exploit, trainer, bot, script, macro, or automation tool.
- Use a modified version of the Game or any third-party software that interferes with gameplay.
- Exploit bugs, glitches, or design errors to gain unfair advantages, unearned Points, or inflated scores.
- Tamper with the Game’s save files, memory, network requests, or any on-device data to alter Points, scores, or rewards.
- Attempt to reverse-engineer, decompile, or modify the Game.
2.3 Consequences of Cheating
Cheating undermines the enjoyment of the Game for everyone. If we detect or reasonably suspect cheating, we may, at our discretion:
- Reset your local leaderboard entries, Points balance, or gameplay progress.
- Block the cheated device or installation from accessing future updates or features.
- Revoke access to rewarded ad rewards or in-game offers.
- Terminate your license to the Game under the EULA.
We do not offer refunds of in-app purchases in cases of cheating-related enforcement.
3. Points, Virtual Items, and Rewards
3.1 Nature of Points
Points (◆) are an in-game virtual currency licensed to you for use within the Service. Points have no monetary value, cannot be redeemed for cash, and cannot be transferred between accounts, devices, or users. Points can be lost if the Game is uninstalled, the device is reset, or the Service is discontinued.
3.2 Earning Points Honestly
The only legitimate ways to obtain Points are:
- Earning them through normal gameplay.
- Purchasing a Points bundle through an official in-app purchase (App Store or Google Play).
- Receiving them through an official in-game promotion we explicitly announce.
Any Points obtained by cheating, exploiting, or circumventing the intended gameplay are void and may be removed without notice or compensation.
3.3 Rewarded Ads
Watching a rewarded video ad during the Continue screen will grant you a golden block. You agree that:
- Rewards are granted only upon the successful completion of a rewarded ad.
- Technical issues (network failures, ad-fill unavailability, or provider errors) may sometimes prevent rewards from being delivered; this is not a breach of these Rules.
- Attempting to circumvent or spoof rewarded ad flows (for example, faking ad completion) is prohibited and may result in enforcement actions.
3.4 No Real-World Trading
You may not sell, auction, trade, or exchange Points, virtual items, gameplay progress, or access to the Game for real-world money or anything else of value outside the Service. Any such transactions are at your own risk, are not recognized by the Company, and may result in enforcement actions.
4. In-App Purchases
4.1 How Purchases Work
In-app purchases of Point bundles are processed by the applicable app store (Apple or Google), not directly by the Company. The Company does not receive, store, or process your payment card details.
4.2 Responsibility for Purchases
You are responsible for all in-app purchases made from your device or through your app store account. Please:
- Use device-level passcodes and require authentication (Face ID, Touch ID, passwords) for purchases.
- Enable parental controls if children use the device.
- Regularly review your app store purchase history.
4.3 Refunds
Because Point bundles are consumable virtual goods, all in-app purchases are generally final. If you believe a purchase was made in error or without authorization, please contact the applicable app store (Apple or Google) for their refund process. We do not directly process refunds.
4.4 Parental Consent for Minors
Minors (anyone under the age of legal majority in their jurisdiction) must obtain parental or guardian consent before making any in-app purchase. Parents and guardians are responsible for supervising minors’ use of in-app purchases.
5. Leaderboard Rules
Upside’s leaderboard is stored locally on your device and ranks your top 10 personal scores. To keep leaderboards fair:
- Only scores achieved through normal gameplay are allowed.
- Scores obtained through cheats, exploits, or modified clients will be reset if detected.
- Scores cannot be transferred between devices.
- We reserve the right to reset leaderboards in connection with updates, seasonal resets, or enforcement actions.
6. Advertising Rules
The Game is supported by advertising. When interacting with ads in Upside:
- Do not click on ads with intent to generate invalid traffic (for example, repeatedly clicking ads without interest in them).
- Do not use tools or scripts to automate ad interactions.
- Do not attempt to bypass, hide, or remove ad displays in the Game.
Invalid traffic harms the Game’s ability to remain free-to-play and violates the policies of our advertising partners.
7. Age and Parental Controls
Upside is intended for players aged 13 and older (or the equivalent minimum age in your jurisdiction). If you are under 18, please play with the involvement of a parent or guardian. Parents and guardians are strongly encouraged to:
- Use built-in parental controls on the device (Screen Time on iOS, Family Link or Digital Wellbeing on Android) to manage gameplay time and restrict in-app purchases.
- Disable personalized advertising for children’s accounts.
- Review these Rules and the Privacy Policy together with the child.
8. Community Conduct
The current version of Upside does not include chat, messaging, or user-generated content. However, if you contact us for support or feedback, please communicate respectfully. We do not tolerate:
- Harassment, threats, or abusive language toward our support team or other players.
- Submitting false reports of bugs, cheating, or other issues.
- Spam, phishing, or attempts at social engineering.
9. Reporting Bugs and Violations
We appreciate your help in keeping Upside fair. If you find a bug, notice suspected cheating, or want to report a violation of these Rules:
- Contact us through the support channel listed in the applicable app store or within the Game.
- Provide a clear description, your device model and OS version, and steps to reproduce the issue if possible.
- Do not exploit the bug while waiting for a response.
Reports submitted in good faith will be reviewed. We may not be able to respond to every report individually.
10. Account, Device, and Data
10.1 Device Security
You are responsible for the security of your device, your app store account, and any credentials used to access the Game. We are not liable for losses caused by your failure to secure your device (for example, allowing unauthorized access to your phone or app store account).
10.2 Data Loss
Because gameplay progress, Points, and leaderboard scores are stored locally on your device, uninstalling the Game or resetting your device will cause this data to be permanently lost. We do not maintain server-side backups of your progress.
11. Updates to These Rules
We may update these Rules from time to time, for example to reflect new features, to address new kinds of misuse, or to comply with new legal requirements. When we do, we will update the “Last Updated” date above and, where practical, notify you through the Game or the applicable app store.
Your continued use of the Service after an update constitutes acceptance of the updated Rules.
12. Enforcement and Discretion
We reserve broad discretion to enforce these Rules in a manner we consider fair and proportionate, including but not limited to issuing warnings, resetting game state, revoking virtual items, disabling features, or terminating access. Our enforcement decisions are final, except where applicable law grants you a right of appeal.
13. Relationship to Other Documents
These Rules are part of a broader set of agreements that govern your use of Upside:
- End User License Agreement (EULA) — governs your license to use the Game.
- Terms of Service — governs your general use of the Service and in-app purchases.
- Privacy Policy — describes how we handle information.
- Rules & Regulations (this document) — explains gameplay, fair play, and community expectations.
In case of conflict, the EULA controls over these Rules, and the Terms of Service control over the Privacy Policy only to the extent the conflict relates to contractual terms rather than data practices.
