1. Copyright Notice

The mobile game “Upside” (the “Game”), including without limitation its source code, object code, gameplay mechanics, level design, user interface, graphics, artwork, icons, logos, fonts, sound effects, music, text, in-game store, and all associated documentation, promotional materials, trailers, and screenshots (collectively, the “Work”), is an original work of authorship and is protected by the copyright laws of the Sultanate of Oman, the Berne Convention for the Protection of Literary and Artistic Works, the WIPO Copyright Treaty, and the copyright laws of all other applicable jurisdictions.
Unauthorized reproduction, distribution, public performance, public display, adaptation, derivative works, or other exploitation of the Work, in whole or in part, by any means and in any medium, is strictly prohibited and may result in civil and criminal penalties, and will be prosecuted to the fullest extent of the law.
2. Trademark Notice
“Upside,” the Upside logo, and all related names, character names, taglines, and distinctive graphics used in connection with the Game are trademarks, service marks, or trade dress of the Developer (collectively, the “Marks”), whether or not registered. All rights to the Marks are expressly reserved.
No license or right is granted by implication or otherwise to use the Marks. Unauthorized use of the Marks is prohibited and may constitute trademark infringement, unfair competition, or passing off under applicable law.
3. Ownership of All Content
All intellectual property rights in and to the Game — including copyrights, trademarks, trade dress, trade secrets, patents (if any), moral rights, database rights, and all other proprietary rights anywhere in the world — are owned exclusively by the Developer or its licensors. This includes:
- Source code and object code — all GDScript, shader, build, and configuration files that make up the Game.
- Game design — the rules, mechanics, progression systems, scoring logic, Points economy, and golden-block pricing ladder.
- Visual assets — the logo, icon, backgrounds, block graphics, HUD elements, menus, animations, and any associated promotional art.
- Audio assets — sound effects, music, and all audio mixing or arrangement created for the Game.
- Text and written content — menu text, in-game messages, tutorial text, credits, and marketing copy.
- User interface and user experience — the layout, look-and-feel, and navigation flow that collectively form the trade dress of the Game.
- Documentation — this notice and the other legal documents distributed with the Game.
Any idea, design, feature, or content contributed to the Game by employees, contractors, or freelancers has been assigned to the Developer by written agreement, or was created by the Developer personally. The Developer has the sole authority to grant, license, or enforce rights in the Work.
4. Permitted Uses
You may only use the Game under the terms of the End User License Agreement (the “EULA”). Subject to the EULA, you may:
- Download, install, and play the Game on a compatible device you own or control, for personal, non-commercial entertainment.
- Take screenshots or short gameplay video recordings of the Game for personal, non-commercial purposes such as sharing with friends or on personal social media, provided that (a) the Upside logo and copyright notice remain intact where reasonably visible, (b) you do not suggest endorsement by or affiliation with the Developer, and (c) your use does not disparage the Game or the Developer.
Content creators (streamers, video creators, reviewers) may stream or record gameplay for non-commercial or monetized platforms such as YouTube or Twitch, provided the use is a genuine commentary, review, or entertainment context that falls within fair use / fair dealing principles of your jurisdiction and does not consist of redistribution of large amounts of the Game’s content (for example, full extraction of assets or cloned builds).
5. Prohibited Uses
Without the prior written permission of the Developer, you may NOT:
- Copy, reproduce, publish, distribute, publicly perform, publicly display, broadcast, or transmit any portion of the Game, except as expressly permitted by the EULA.
- Extract, rip, datamine, or otherwise recover the Game’s assets (images, sounds, fonts, code, or data) for any purpose.
- Create derivative works, spin-offs, mods, reskins, or clones based on the Game’s design, artwork, code, or mechanics.
- Develop, publish, or distribute a competing game that copies the Game’s look, feel, structure, or distinctive features (including the Points system or golden-block mechanic).
- Use the Marks or the Game’s name in a way that suggests endorsement, sponsorship, or affiliation.
- Reverse-engineer, decompile, or disassemble the Game, except to the extent such activity is expressly permitted by applicable law notwithstanding this restriction.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices embedded in the Game.
- Use the Game or any part of it to train, fine-tune, or evaluate generative AI models, machine learning systems, or any automated content-generation system.
- Sell, license, rent, or otherwise commercialize any derivative, mod, or copy of the Game.
6. Third-Party Components and Attributions
The Game is built using and incorporates certain third-party software, assets, and services. Their use is governed by their respective licenses. Key third-party components include:
6.1 Godot Engine
The Game is built on the Godot Engine, a free and open-source game engine distributed under the MIT License.

6.2 Google AdMob
The Game integrates the Google Mobile Ads SDK (“AdMob”) to display banner, interstitial, and rewarded video advertisements. AdMob is provided by Google LLC and/or Google Ireland Limited and is used under the Google Mobile Ads SDK terms and Google’s developer policies. “AdMob” and “Google” are trademarks of Google LLC.
6.3 Apple StoreKit and Google Play Billing
In-app purchases on iOS are processed through Apple’s StoreKit framework; in-app purchases on Android are processed through Google Play Billing. “Apple,” the Apple logo, “App Store,” “StoreKit,” and other Apple trademarks are the property of Apple Inc., registered in the U.S. and other countries. “Google Play” and the Google Play logo are trademarks of Google LLC.
6.4 Fonts
Any third-party fonts included with the Game are used under licenses that permit their embedding in and distribution as part of the Game. Attribution, if required by the applicable font license, is provided in the Game’s in-app credits or in the font license file distributed with the Game.
6.5 Other Third-Party Assets
If any additional third-party assets (images, sounds, plugins, libraries) are used in the Game, their respective licenses and attribution requirements are included in the Game’s credits or a bundled third-party notices file. The use of any such asset does not transfer or imply a transfer of any intellectual property rights from the third-party owner.
7. Claims of Copyright Infringement
If you believe that content in the Game, or content associated with the Game that we control, infringes your copyright, please submit a written notice to us that includes:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it.
- Your contact information (name, address, phone number, email).
- A statement that you have a good-faith belief that the disputed use is not authorized.
- A statement, under penalty of perjury, that the information in the notice is accurate, and that you are the owner or authorized to act on behalf of the owner.
Send your notice to us through the support channel listed in the applicable app store or within the Game. Knowingly submitting a false notice may subject you to liability under applicable law.
8. Counter-Notification
If you believe that material you created or uploaded was wrongly removed or access was disabled, you may submit a counter-notification containing the information required by applicable law. Counter-notifications may be sent through the same support channel.
9. Reservation of Rights
All rights not expressly granted in this notice, the EULA, or the Terms of Service are reserved by the Developer. No rights are granted to you by implication, estoppel, or otherwise.
10. Enforcement
The Developer actively monitors for and enforces its intellectual property rights. We may use technical measures, legal notices, takedown requests (for example, DMCA notices in the United States), and, where necessary, litigation to protect the Work. We may also engage app store operators (Apple and Google) to take action against infringing or cloned products.
11. Changes to This Notice
We may update this Copyright Notice from time to time. The “Last Updated” date at the top will reflect the most recent revision.
12. Contact
To request licensing, permission for a use not expressly authorized, or to report suspected infringement, contact the Developer through the support channel listed in the applicable app store or within the Game.
